Hampe v Hamos 

The Hampe vs. Hamos lawsuit concerns individuals who age out of the Medically Fragile, Technology Dependent (MF/TD) waiver program upon turning 21 years old and become ineligible for the MF/TD waiver program. The lawsuit was certified as a class action in November 2010 in the United States District Court for the Northern District of Illinois. On July 9, 2013, Federal Judge Ruben Castillo granted preliminary approval to a Class Action Settlement (Consent Decree) of the lawsuit. The settlement was reached to resolve the case and to continue to provide medically necessary benefits to Class Members after they turn 21 years old. On October 3, 2013, Judge Castillo will conduct a fairness hearing to determine whether the terms of the Consent Decree are fair, reasonable, and adequate, and should be approved by the Court.
