Within the Draft Statewide Transition Plan posted in February of 2020 (*See Page 13, under “Heightened Scrutiny”), Illinois committed to updating evidentiary packages for all previously identified Heightened Scrutiny Settings as well as developing evidentiary packages for any newly identified Heightened Scrutiny Settings. To demonstrate compliance with Federal Regulatory Requirements for HCBS Settings, the Department will post updated evidentiary packages in batches, the first batch of settings are overseen by the Illinois Department of Healthcare and Family Services’ (HFS) Supportive Living Program (SLP). This batch includes Heightened Scrutiny SLP locations that are either a) located in a building that is also a publicly or privately-operated facility that provides inpatient institutional treatment; or b) located in a building located on the grounds of, or immediately adjacent to, a public institution.
Asbury Court, Asbury Gardens, and The Pointe Kilpatrick Conventional SLP locations also house approved Dementia Care Settings within their buildings. On 06/28/2021, public comment was posted for an amendment to the SLP waiver that allows for prospective and current residents to reside in approved Dementia Care Settings when delayed egress is not a needed safety intervention. The Public Comment Notice can be located here. These residents will have access to leave the building independently at any time they choose. Changes to the delayed egress requirement have been communicated to SLP providers by way of HFS provider notices.
