DRAM SHOP LIABILITY LIMITS
Section 6-21(a) of the Liquor Control Act of 1934 (235 ILCS 5/6-21(a)) requires the Illinois Office
of Comptroller to determine each year the liability limits for causes of action brought under
the Act in accordance with the consumer price index-u (CPI-U) during the preceding 12-month
calendar year.
2021 Dram Shop Liability Limits
According to the U.S. Bureau of Labor Statistics, the CPI-U increased 1.36% during the
preceding calendar year. Based upon the previous determinations, the liability limits are
adjusted as follows:
• For final judgments or settlements awarded on or after January 20, 2021 for causes
of action involving persons injured, killed, or incurring property damage, the judgment
or recovery under the Liquor Control Act of 1934 for injury to the person or property
of any person shall not exceed $72,671.25 for each person incurring damages; and
• For final judgments or settlements awarded on or after January 20, 2021 for causes
of action under the Liquor Control Act of 1934 for either loss of means of support or
loss of society resulting from the death or injury of any person, the recovery shall not
exceed $88,820.41.
Minimum Amount of coverage is $234,162.91
